• “Credits”: virtual units purchased or earned within the platform to access certain features; not redeemable for cash or fiat currency.
• “Subscription Plan”: recurring paid service plans provided by Sousaku AI.
• “Cooling-off Period”: the withdrawal right granted under applicable consumer protection laws.

2. Service Description

Sousaku AI is an AI-powered creative platform providing, but not limited to:

• AI-driven image generation, editing, and enhancement
• AI-powered video creation and enhancement tools
• Prompt assistance and creative generation utilities

Sousaku AI reserves the right to modify, suspend, or discontinue part or all of the Service at any time.
In the event of significant changes, users will be notified via email or public announcement. For paid users, reasonable alternatives or compensation may be offered.

3. User Accounts and Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must obtain parental or guardian consent.
You are responsible for:

• Maintaining account security;
• All activity occurring under your account;

Sousaku AI may suspend or terminate accounts containing false or misleading information.

5. Intellectual Property

5.1 User Content

You retain ownership of your original content submitted to the Service.
You grant Sousaku AI a non-exclusive, worldwide, royalty-free license to store, process, and display such content for the purpose of providing and improving the Service.

5.2 Generated Content

Upon compliance with these Terms and payment of applicable fees, you own the Generated Content created by Sousaku AI’s models based on your input.
Sousaku AI grants you a non-exclusive, worldwide license for commercial use of the Generated Content.
You are solely responsible for ensuring your use of Generated Content does not infringe any third-party rights. Sousaku AI disclaims liability for disputes arising from commercial use.

6. Payment and Subscription

Sousaku AI operates on a Freemium model offering optional paid subscriptions and credit top-ups. Paid features may include:

• High-resolution outputs
• Priority processing and faster queues
• Access to advanced AI models
• Commercial usage rights

6.1 Payment and Renewal

All plans are prepaid. By purchasing, you authorize Sousaku AI and its payment processors to charge your selected payment method automatically.
Subscriptions automatically renew unless canceled prior to the renewal date.

6.2 Withdrawal and Refunds

Unless otherwise required by law, all purchases are final and non-refundable.
For EU and applicable regions, you will be informed that digital content will be delivered immediately upon purchase. By proceeding, you expressly request immediate service performance and waive your 14-day withdrawal right.

7. Privacy and Data Protection

Sousaku AI values your privacy.
Our data collection, storage, and processing practices are governed by our Privacy Policy, which is incorporated by reference.

Sousaku AI employs industry-standard security measures but cannot guarantee absolute security.

7.1 Data Use and Third-Party Responsibility

Sousaku AI does not disclose unnecessary personal information to any third party and does not use user data for model training.
Sousaku AI requires all integrated third-party API providers not to use user-generated data for training or reuse without explicit consent.
However, Sousaku AI cannot strictly guarantee full compliance by third-party providers. Sousaku AI shall not be liable for any data breaches, privacy violations, or losses arising from third-party actions.

7.2 Data Retention and Deletion

Sousaku AI retains user data only for as long as necessary to provide the Service, fulfill contractual obligations, or comply with legal requirements.
Users may request deletion of their accounts and related data.
For security and compliance, system logs or backups may be retained for up to 90 days post-deletion.

8. Credits and Virtual Assets

Credits can only be used within Sousaku AI. They hold no monetary value, are non-transferable, and non-redeemable for fiat currency.
Credits are non-refundable and will be forfeited upon account termination.

9. User Feedback

Any feedback, suggestions, or comments submitted by users may be freely used by Sousaku AI for product improvement, marketing, or other legitimate purposes without compensation.

10. Limitation of Liability

To the maximum extent permitted by law, Sousaku AI and its affiliates shall not be liable for:

• Indirect, incidental, special, or consequential damages;
• Loss of profits, data, or business opportunities;
• Damages arising from use or inability to use the Service.

Sousaku AI’s total cumulative liability shall not exceed the total amount paid by you within the twelve (12) months preceding the claim.

11. Force Majeure

Sousaku AI shall not be liable for delays or failures caused by natural disasters, internet outages, third-party API failures, government actions, cyberattacks, or other events beyond reasonable control.
We will make reasonable efforts to restore service promptly.

12. Termination

Either party may terminate this Agreement at any time.
Sousaku AI may suspend or terminate your account immediately if you violate these Terms.
Upon termination, unused credits and prepaid fees are non-refundable.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Japan.
Any dispute arising out of or relating to these Terms shall first be addressed through good-faith negotiations between the parties.
If the dispute cannot be resolved through negotiation, it shall be submitted to arbitration administered by the Japan Commercial Arbitration Association (JCAA), with Tokyo as the seat of arbitration. The arbitration shall be conducted in Japanese or English.
